WILL & LPA PACKAGE FAQs

Do I need to make my Will and LPAs at the same time?
No. You can arrange a Will or Lasting Power of Attorney separately. However, many clients choose to deal with them together because it is a practical way to get their affairs in order in one go — and our packages are designed to save money compared with arranging each service individually.
Does making a Lasting Power of Attorney mean I lose control?
No. Making an LPA does not mean you are giving up control of your life, money or decisions. It allows you to choose people you trust to help if you ever need support in the future. Rebecca will explain how LPAs work, when they can be used, and the safeguards involved, so you feel comfortable with your decisions.
Who should I choose as my attorneys?
Your attorneys should be people you trust to act carefully and in your best interests. This might be family members, close friends or, in some cases, professional attorneys. Rebecca will discuss your circumstances with you and help you think through the practical issues before you decide.
For Property and Finance, your attorneys must be over 18, have mental capacity and they must not be bankrupt or subject to a Debt Relief Order. For a Health and Welfare attorney, they must be over 18 and have mental capacity.
It is sensible to have at least two attorneys. You can appoint replacement attorneys to take over if an original attorney can’t act. This might happen if they lose capacity, become bankrupt, resign, or die.
Choosing your attorneys is crucial because you are appointing them to make decisions for you. You must feel confident in their abilities, judgment, and decision making.
A Property and Finance attorney will handle bank accounts, investments, benefits, bills, and property. So, choose attorneys who are reliable, organised, and good with money. Some professionals will act as attorneys.
A Health and Welfare attorney is only going to act when you lack mental capacity. They will make decisions about your personal wellbeing. This could involve care plans, where you live, your daily activities, and medical care.
They will have access to your medical information. These issues are very personal and close friends or family members who understand your values are a good choice. It is unusual for a professional to act as a Health and Welfare attorney.
What is included in the Will and LPA packages?
The single person package includes a Will, an Inheritance Tax review, and both types of LPA: Property and Financial Affairs, and Health and Welfare.
The couples package includes mirror Wills, an Inheritance Tax review, and both types of LPA for each person.
Are there any extra costs?
Yes. We charge a fixed fee for writing your Will and preparing your LPAs, but there are additional fees:
Identification: All llaw firms are required to confirm individuals' identities. This means you and your attorneys have to be identified. the cost is an additional £30 +£6 VAT = £36 per person.
Court of Protection: The Court of Protection charges a fee of £92 per LPA. So, if you make both, that's an extra £184.
We make sure the total cost is completely clear to you at the start.
What happens after I arrange an appointment?
When you arrange an appointment we will confirm the total price for our services, and additional costs, in writing.
We will send you brief forms to help you think about your wishes and what arrangement you would like to make. This helps you prepare – so you can get the most out of your meeting with Rebecca.
We will also send you an email with a link to an online system to confirm your identity. Alternatively you can show us identification documents (eg passport and driving licence) at your meeting.
Put the right arrangements in place – before they are needed
Your Will records your wishes and ensures the people and causes you care about are provided for.
Lasting Powers of Attorney let you choose people you trust to help if illness, accident or incapacity ever makes life difficult.
Like insurance, an LPA must be arranged in advance. Put everything in place now, with clear advice from Rebecca Padgett, and gain the reassurance of knowing your affairs are in order.
